Senator Rucker moved to amend the bill by striking out the title and substituting therefor a new title, to read as follows:

Eng. House Bill 3412—A Bill to amend and reenact §29B-1-1, §29B-1-2, §29B-1-3, §29B-1-3a, §29B-1-4, §29B-1-5, and §29B-1-7 of the Code of West Virginia, 1931, relating to modifying certain provisions regarding disclosure of public records; expanding the types of records and information that are not subject to or are exempt from pubic disclosure; modifying how the
Freedom of Information Act is to be construed and removing the presumption of public accessibility; increasing the time period for responding to record requests; authorizing reasonable search and retrieval fee to be charged for responding to record requests; removing the burden on a public body to sustain its action regarding withholding records; and modifying certain provisions regarding the award of attorneys’ fees and costs when access to certain records is denied.
